Rental conditions
Are an integral part of the lease contract concluded between KLIM cars s.r.o., ID company: 08552673, with its registered office at Lidická 217, Klimkovice 742 83, (hereinafter referred to as the Lessor) and the Lessee for the lease of the vehicle.
1. Rental agreement
The lease agreement is concluded for a definite period of time, starting from the date and time specified therein and terminates upon expiry of the agreed lease period. The lease term may be extended no later than 12 hours before the expiry of the period for which the lease agreement was originally agreed, if the lessor confirms the extension. In this case, the tenants shall retain all the agreed terms and conditions. If the lease is not renewed, the return of the vehicle by the lessee later than the time agreed in the contract is considered a violation of the lease and the lessee agrees that the landlord can report the vehicle as lost or stolen to the police authorities. file a lawsuit with the competent court, the consequences of which may be borne exclusively by the lessee.
The lessee is obliged to pay the rent incl. all fees until the car is handed over back to the lessor in full. In addition, the day on which the vehicle was to be returned to the lessor under the lease agreement, it loses the right to limit its liability under the agreed conditions (see point 5).
In the event of theft or vehicle crash, the lessee is obliged to pay the rent including all other charges until the theft or vehicle crash is reported to the lessor or the lessor is otherwise aware of the theft or vehicle crash.
The Lessor is obliged to hand over the vehicle to the Lessee in good technical condition, at the time and place specified in the Lease Agreement. Any apparent defects, complaints and comments regarding the rented vehicle must be claimed by the lessee at the latest upon receipt of the vehicle and must be recorded in the lease agreement.
The Lessee is obliged to return the vehicle to the Lessor including all accessories and documents, at the time and place specified in the Lease Agreement and in the condition in which it was taken over with respect to normal wear and tear. The vehicle, including documents and keys, must be taken over by the lessor's designated employee.
2. Terms of use
Only persons older than 21 years (luxury category 25) specified in the rental agreement can use and drive the rented vehicle. The Lessee is obliged to use the rented vehicle solely for personal purposes and to observe all traffic and other valid regulations. The Lessee is obliged to take care that the vehicle does not cause damage and to observe the conditions and recommendations set by the Lessor.
The lessee is obliged to secure the vehicle against theft, misuse or damage. In particular, after parking, he is obliged not to leave keys and documents in the vehicle and to lock the vehicle. Breach of any of these obligations is considered a material breach of the lease.
The Lessee may not cease using the vehicle other than the person specified in the contract, participate in competitions, competitions or similar events with the vehicle, use the vehicle to transport persons or property for remuneration, use the vehicle to push or tow cars, trailers or other objects. vehicle changes and modifications.
The lessee must not drive the vehicle after taking alcohol, narcotics, medicines or other substances that may affect the perception and ability to react, or let the person to drive the vehicle, otherwise he will pay all possible damages in full.
The Lessor is entitled to request access to the vehicle in order to check that the Lessee is using them properly in accordance with the terms of the Lease Agreement. The Lessee is obliged to enable the Lessor to do so immediately.
In case the lessee wants to use the rented vehicle abroad, he is obliged to ask the lessor's permission first. Consequently, the vehicle can only be used in EU countries with the exception of Romania, Bulgaria, Estonia, Lithuania and Latvia. At the same time, entry to all candidate countries such as Macedonia, Montenegro, Serbia, Albania, Bosnia and Herzegovina and Kosovo is prohibited. The Lessee is aware that in case of breach of this obligation the vehicle will be reported as stolen and thus subject to possible arrest and detention of the vehicle. The Lessee shall be liable to the Lessor for any damage that would result from failure to comply with or breach of this obligation. In this case, the lease period shall not end before the vehicle is returned to the lessor. In addition, the Lessee is obliged to cover all costs incurred in transport to the place of return specified in the Contract.
3. Rent and fees
The lessee undertakes to pay the rent and all other fees specified in the lease contract, to which he has signed by himself, duly and on time to the lessor.
In the case of rented for more than one month, billing or invoicing will be performed continuously. Monthly rent is payable in advance, always for the following month or part thereof.
The deposit based on the vehicle type and the length of the lease, which the lessee is obliged to deposit with the lessor upon signing the lease in the form of pre-authorization on the payment card, will be settled after returning the car. The deadline for re-unblocking funds depends on the client's bank. The deposit is without prejudice to the tenant's obligation to pay the rent. The amount of the deposit will be determined by the landlord, which can be increased and accounted for during the lease according to the actual costs incurred in renting the vehicle.
4. Repairs and maintenance
Routine repairs, maintenance of the vehicle as well as regular service inspections of the vehicle will be carried out or arranged by the Lessor. The Lessee is obliged to allow repairs, maintenance, service inspection of the vehicle and to suffer restrictions on the use of the vehicle to the extent necessary for their performance. The Lessee has the right to a replacement vehicle for the period of service or repair from liability insurance of another vehicle.
If the lessee does not deliver the rented car for regular service (displayed on the car display) or delivers the car after exceeding the prescribed limit by more than 900 km, the lessee pays a contractual penalty of 10% of the purchase price of the car.
The cost of repairing shall be borne by the lessor, except in cases where the need for repair arises as a result of improper use of the vehicle, or in contradiction with the usual way of use or repair. violation of the terms of this lease or by the lessee or persons to whom the lessee has given access to the vehicle In such cases, the Lessee shall bear the full cost of the repair and the Lessee shall be liable for the full damage incurred as a result of such activity.
The Lessee is obliged to notify the Lessor without undue delay of any defects that occur on the vehicle during use and require repair. If the lessee fails to fulfill this obligation without undue delay, he is liable to the lessor for the damage caused thereby and loses the claims that he otherwise had due to impossibility or limited possibility to use the thing for defects.
5. Materials responsibility
The Lessor provides persons authorized to drive a vehicle to the extent and under the conditions of statutory liability insurance for damage caused by the operation of a motor vehicle.
Unless agreed otherwise, the lessee pays a deductible of 10% of the total damage min. CZK 10,000. Damage to accessories is paid in full.
The deductible is paid whenever the damage is caused by the lessee or the culprit is not known, as is the cost of transporting the vehicle back to the lessor.
The penalties imposed by the Lessee for road traffic offenses, damages caused by the loss of documents, keys or vehicle accessories, including the costs incurred to remedy such damages, are always borne by the Lessee.
6. Accident, damage and theft of the vehicle
In the event of a traffic accident, damage or theft of the vehicle, or. parts, injuries, or death of persons (regardless of whether the tenant was caused or not) the lessee is obliged to notify the lessor and the police to investigate the accident and the investigation, respectively. of its result, the Lessee has issued a certificate, which it is obliged to immediately give to the Lessor.
In the event of any loss event, the lessee is always obliged to fill in all the information required in the "Accident Notification" form received with the documents for the rented vehicle. An immobilized vehicle must be secured against further damage or theft.
The Lessee is obliged to provide the Police, the Lessor and its insurance company with all assistance and assistance necessary for the full investigation of the claim and related to its liquidation or its court hearing.
7. Processing of personal data
The processing of personal data is carried out in a lawful manner and in accordance with Act No. 101/2000 Coll., On the protection of personal data and with the new REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (known as GDPR). We always have a legal reason to process personal data. Processing is governed by processing rules and principles.
8. Others
The Lessee agrees that the data from this lease agreement incl. his personal data were processed and stored in the landlord's database.
If the Lessee uses the vehicle in violation of the agreed conditions or in the manner of causing or threatening to the Lessor the damage, the Lessor has the right to terminate the lease with immediate effect. The lessor may also terminate the contract if the lessee does not pay the rent in the agreed amounts and terms.
In matters not expressly regulated by this lease agreement (and conditions), the lease relationship is governed by the relevant provisions of the legal regulations of the Czech Republic.
